Les CDV sont présentes dans le catalogue PDF ou ci-dessous: CONDITIONS DE VENTE Boisgirard – Antonini Paris est une société de ventes volontaires de meubles aux enchères publiques régie par la loi du 10 juillet 2000. En cette qualité Boisgirard – Antonini agit comme mandataire du vendeur qui contracte avec l’acquéreur. Les rapports entre Boisgirard – Antonini et l’acquéreur sont soumis aux présentes conditions générales d’achat qui pourront être amendées par des avis écrits ou oraux qui seront mentionnés au procès-verbal de vente. 1 – Le bien mis en vente a) Les acquéreurs potentiels sont invités à examiner les biens pouvant les intéresser avant la vente aux enchères, et notamment pendant les expositions. Boisgirard – Antonini Paris se tient à la disposition des acquéreurs potentiels pour leur fournir des rapports sur l’état des lots. b)Tous les biens sont vendus tels quels dans l’état où ils se trouvent au moment de la vente avec leurs imperfections ou défauts. Aucune réclamation ne sera possible relativement aux restaurations d’usage et petits accidents. Il est de la responsabilité des futurs enchérisseurs d’examiner chaque bien avant la vente et de compter sur leur propre jugement aux fins de vérifier si chaque bien correspond à la description. Le ré-entoilage, le parquetage, l’état des cadres ou le doublage constituant une mesure conservatoire et non un vice ne seront pas signalés. Les dimensions sont données à titre indicatif, notamment en ce qui concerne les œuvres encadrées. c)Les indications données par Boisgirard – Antonini sur l’existence d’une restauration, d’un accident ou d’un incident affectant le lot, sont exprimées pour faciliter son inspection par l’acquéreur potentiel et restent soumises à son appréciation personnelle ou à celle de son expert. L’absence d’indication d’une restauration, d’un accident ou d’un incident dans le catalogue, les rapports, les étiquettes ainsi que verbalement, n’implique nullement qu’un bien soit exempt de tout défaut présent, passé ou réparé. Inversement la mention de quelque défaut n’implique pas l’absence de tous autres défauts. d)Les estimations sont fournies à titre purement indicatif et elles ne peuvent être considérées comme impliquant la certitude que le bien sera vendu au prix estimé ou même à l’intérieur de la fourchette d’estimations. e) Tout bordereau d’adjudication demeuré impayé auprès de Boisgirard-Antonini ou ayant fait l’objet d’un retard de paiement est susceptible d’inscription au Fichier TEMIS. 2 – La vente Les enchérisseurs peuvent consulter en ligne les catalogues de ventes via le site : boisgirard-antonini.com a) En vue d’une bonne organisation des ventes, les acquéreurs potentiels sont invités à se faire connaître auprès de Boisgirard, avant la vente, afin de permettre l’enregistrement de leurs données personnelles. Aucune demande d’ordre d’achat ou de demande de ligne téléphonique ne sera acceptée par e-mail. Merci de passer directement par les différentes plateformes disponibles. Boisgirard – Antonini se réserve de demander à tout acquéreur potentiel de justifier de son identité ainsi que de ses références bancaires. Boisgirard – Antonini se réserve d’interdire l’accès à la salle de vente de tout acquéreur potentiel pour justes motifs. b) Toute personne qui se porte enchérisseur s’engage à régler personnellement et immédiatement le prix d’adjudication augmenté des frais à la charge de l’acquéreur et de tous impôts ou taxes qui pourraient être exigibles. Tout enchérisseur est censé agir pour son propre compte sauf dénonciation préalable de sa qualité de mandataire pour le compte d’un tiers, acceptée par Boisgirard – Antonini. c) Le mode normal pour enchérir consiste à être présent dans la salle de vente. Toutefois Boisgirard – Antonini pourra accepter gracieusement de recevoir des enchères par téléphone d’un acquéreur potentiel qui se sera manifesté avant la vente. Boisgirard – Antonini ne pourra engager leur responsabilité notamment si la liaison téléphonique n’est pas établie, est établie tardivement, ou en cas d’erreur ou d’omissions relatives à la réception des enchères par téléphone. Boisgirard – Antonini ne pourra engager leur responsabilité notamment en cas d’erreur ou d’omission d’exécution d’un ordre écrit. d) Dans l’hypothèse où un prix de réserve aurait été stipulé par le vendeur, Boisgirard – Antonini se réserve de porter des enchères pour le compte du vendeur jusqu’à ce que le prix de réserve soit atteint. e) Boisgirard – Antonini dirigera la vente de façon discrétionnaire tout en respectant les usages é Boisgirard – Antonini se réserve de refuser toute enchère, d’organiser les enchères de la façon la plus appropriée, de déplacer certains lots lors de la vente, de retirer tout lot de la vente, de réunir ou de séparer des lots. En cas de contestation Boisgirard – Antonini se réserve de désigner l’adjudicataire, de poursuivre la vente ou de l’annuler, ou encore de remettre le lot en vente. f)L’adjudicataire ne pourra obtenir la livraison du lot qu’après règlement de l’intégralité du prix. g) L’Utilisateur doit s’assurer qu’il dispose des outils techniques adaptés à l’utilisation des Services et, au minimum, des recommandations techniques suivantes permettant d’optimiser l’accès aux Services : dernière version des navigateurs existants sur le marché, une connexion Internet haut débit. 3 – Les incidents de la vente a)Dans l’hypothèse où deux personnes auront porté des enchères identiques par la voix, le geste, ou par téléphone et réclament en même temps le bénéfice de l’adjudication après le coup de marteau, le bien sera immédiatement remis en vente au prix proposé par les derniers enchérisseurs, et tout le public présent pourra porter de nouvelles enchères. b)Pour faciliter la présentation des biens lors de ventes, Boisgirard – Antonini pourra utiliser des moyens vidéos. Les photos du catalogue ne sont pas contractuelles. En cas d’erreur de manipulation pouvant conduire pendant la vente à présenter un bien différent de celui sur lequel les enchères sont portées, Boisgirard- Antonini ne pourra engager leur responsabilité, et sera seul juge de la nécessité de recommencer les enchères. 4 – Préemption de l’État français L’État français dispose d’un droit de préemption des œuvres vendues conformément aux textes en vigueur. L’exercice de ce droit intervient immédiatement après le coup de marteau, le représentant de l’État manifestant alors la volonté de ce dernier de se substituer au dernier enchérisseur, et devant confirmer la préemption dans les 15 jours. Boisgirard – Antonini ne pourra être tenu pour responsable des conditions de la préemption pour l’État français. 5 – L’exécution de la vente En sus du prix de l’adjudication, l’adjudicataire (acheteur) devra acquitter par lot les commissions et taxes suivantes : Lots en provenance de l’Union européenne : Les frais sont de 25 % + TVA (soit 30% TTC). Les frais pour les livres sont de 26.37 % TTC Les lots précédés d’un. sont vendus par un associé ou par un collaborateur de la Maison de vente. Ces frais seront précisés avant la vente. En cas de règlement par Carte Bleue étrangère, la Maison de Vente Boisgirard – Antonini facturera 1 % en sus du montant de l’adjudication. b) Les lots précédés d’un * seront assujettis à la TVA supplémentaire de 5,5 % s’ils restent en France ou en Union européenne La TVA à l’import peut être rétrocédée à l’adjudicataire sur présentation des justificatifs d’exportation hors Union européenne dans les deux mois qui suivent la vente. Le paiement du lot aura lieu au comptant, pour l’intégralité du prix, des frais et taxes, même en cas de nécessité d’obtention d’une licence d’exportation. – L’adjudicataire pourra s’acquitter par les moyens suivants : – en espèces : jusqu’à 1 000 € frais et taxes compris pour les ressortissants français et 15 000 € pour les ressortissants étrangers sur présentation de leurs papiers d’identité. – Par virement bancaire. – Par carte de crédit : VISA – MASTERCARD. c) Les achats effectués via DROUOT LIVE seront assujettis à des frais acheteur de 1,5% HT en sus des frais de 30% TTC Les achats effectués via Interenchères, Invaluable et 51BidLive seront assujettis à des frais acheteurs de 3%HT en sus des frais de 30% TTC. Les achats effectués via DROUOT ONLINE seront assujettis à des frais acheteurs de 3%HT en sus des frais de 30% TTC. d)Dans l’hypothèse où l’adjudicataire ne se sera pas fait enregistrer avant la vente, il devra communiquer les renseignements nécessaires dès l’adjudication du lot prononcée. e)Il appartiendra à l’adjudicataire de faire assurer le lot dès l’adjudication. Il ne pourra recourir contre Boisgirard- Antonini, dans l’hypothèse du vol, de la perte ou de la dégradation de son lot, après l’adjudication. f)Le lot ne sera délivré à l’acquéreur qu’après paiement intégral du prix des frais et des taxes. Dans l’intervalle Boisgirard – Antonini pourra facturer à l’acquéreur des frais de dépôt du lot, et éventuellement des frais de manutention et de transport. À défaut de paiement par l’adjudicataire, après mise en demeure restée infructueuse, le bien est remis en vente à la demande du vendeur sur folle enchère de d’adjudicataire défaillant ; si le vendeur ne formule pas cette demande dans un délai d’un mois à compter de l’adjudication, la vente est résolue de plein droit, sans préjudice de dommages intérêts dus par l’adjudicataire défaillant. En outre, Boisgirard – Antonini se réserve de réclamer à l’adjudicataire défaillant, à son choix : – des intérêts au taux légal majoré de cinq points. – le remboursement des coûts supplémentaires engendrés par sa défaillance. – le paiement de la différence entre le prix d’adjudication initial et le prix d’adjudication sur folle enchère s’il est inférieur, ainsi que les coûts générés par les nouvelles enchères. Boisgirard – Antonini se réserve d’exclure de ses ventes futures, tout adjudicataire qui aura été défaillant ou qui n’aura pas respecté les présentes conditions générales d’achat. Il est vivement demandé aux adjudicataires de procéder à un enlèvement le plus rapide possible de leurs achats, afin de limiter les frais de stockage qui sont à leur charge. Les achats de petits volumes seront transportés chez Boisgirard – Antonini où ils seront gardés à titre gracieux pendant quinze jours. Passé ce délai, des frais de dépôt seront supportés par les acquéreurs au tarif de 3 € par jour et par lot. L’entreposage des lots ne saurait engager en aucune façon la responsabilité de la SVV Boisgirard – Antonini. Pour les ventes à Drouot, les objets sont à retirer au magasinage de l’Hôtel Drouot, dont les frais sont à la charge des acheteurs. Veuillez contacter un transporteur de votre choix après réception du bordereau soldé. f) Garanties horlogerie et bijoux Boisgirard Antonini applique les appellations selon les normes et réglementations techniques confirmes au décret n°2002-65 du 14 janvier 2002. a) Boisgirard-Antonini désigne les pierres modifiées par « les pratiques lapidaires traditionnelles » de la même manière que celles qui n’auraient pas été modifiées. Boisgirard-Antonini désigne les pierres modifiées par d’autres procédés, par le nom de la pierre, suivi de la mention « traitée » ou par l’indication du traitement subi. (Art.2) Les pierres non accompagnées de certificats ou attestations de laboratoires ont été estimées par Boisgirard-Antonini en tenant compte des modifications éventuelles du paragraphe a). c) Boisgirard-Antonini désigne par le terme générique PIERRE suivi d’un qualificatif de couleur les désignations suivantes : pierres synthétiques, pierres artificielles et imitations de pierres gemmes. En ce qui concerne les montres, les restaurations, les modifications, les caractéristiques techniques, les numéros de séries, les dimensions, le poids sont notifiés dans la mesure de nos moyens. L’état de fonctionnement n’est pas garanti. Il est possible que certains lots comprennent des pièces non originales suite à des réparations ou révisions de la montre ou de l’horloge. Ces éléments ne sont donnés qu’à titre indicatif pour faciliter l’inspection de l’acquéreur potentiel et restent soumises à son appréciation personnelle. La responsabilité du commissaire-priseur et de l’expert ne saurait être mise en cause en cas d’omissions pouvant subsister malgré les précautions prises. L’absence d’indication n’implique nullement qu’une montre soit exempte de défaut. Aucune garantie n’est faite sur l’état des montres et des bracelets. Les révisions, réglages et l’étanchéité restent à la charge de l’acquéreur. La mention or, platine et argent sans indication complémentaire décrivent les lots en or 750 millièmes, en platine 950 millièmes et en argent 925 millièmes. 6- Paiement en ligne & Dépôt d’avance Un formulaire de paiement en ligne permet à l’utilisateur de régler ses adjudications à distance en Indiquant simplement le numéro du bordereau à régler, son montant, ainsi que son nom et son adresse email. Les opérations de paiement sont effectuées par la Maison de Vente par l’intermédiaire de son prestataire de paiement : Ingenico, certifiée PCI-DSS a)Obligations de l’Enchérisseur potentiel : Celui-ci doit s’assurer qu’il dispose des outils techniques adaptés à l’utilisation des Services et, au minimum, des recommandations techniques suivantes permettant d’optimiser l’accès au service. La Maison de vente ne peut en aucun cas être tenu responsable en cas d’incidents liés à des informations mal renseignées de sa part. b)Données personnelles : La Maison de vente s’engage à respecter la réglementation en vigueur applicable au traitement de données à caractère personnel et en particulier, le règlement (UE) 2016/679 (RGPD) 7 – Propriété intellectuelle – reproduction des œuvres Boisgirard – Antonini est propriétaire du droit de reproduction de leur catalogue. Toute reproduction de celui-ci est interdite et constitue une contrefaçon à son préjudice. En outre Boisgirard – Antonini dispose d’une dérogation légale leur permettant de reproduire dans son catalogue les œuvres mises en vente, alors même que le droit de reproduction ne serait pas tombé dans le domaine public. La Maison de Vente est seul titulaire de tous les droits relatifs aux contenus afférents au Site et notamment à l’ensemble des droits d’auteur sur les contenus qu’elle met en ligne sur son site. L’Utilisateur s’interdit de reproduire, représenter, extraire, ou utiliser de quelque manière que ce soit tout ou partie du Site ou de son contenu et notamment les catalogues sans avoir obtenu une autorisation préalable et écrite de la Maison de Vente sous peine de voir une action judiciaire en contrefaçon engagée à son égard. 8- Responsabilité de la maison de vente Boisgirard-Antonini s’efforce, dans la mesure du possible et dans le cadre de son obligation de moyens relative au fonctionnement du Site, de le maintenir accessible. Néanmoins, l’accès au site peut être modifié, suspendu ou interrompu de manière temporaire ou permanente, en raison d’opérations techniques de maintenance, de migration, de pannes ou de contraintes liées au fonctionnement d’internet sans que ces opérations n’ouvrent droit à une quelconque indemnité. Boisgirard-Antonini ne saurait voir sa responsabilité engagée en raison d’un dysfonctionnement ou d’une impossibilité d’accès aux services imputable au fournisseur d’accès de l’utilisateur, à un encombrement du réseau internet, à un matériel inadapté, à une opération de maintenance ou de mise à jour des services ou à tout autre circonstance étrangère à la Maison de vente. 9- Compétences législative et juridictionnelle La loi française seule régit les présentes conditions générales d’achat. Toute contestation relative à leur existence, leur validité, leur opposabilité à tout enchérisseur et acquéreur, et à leur exécution sera tranchée par le tribunal compétent du ressort de Paris (France). 10- La sortie du territoire français La sortie d’un lot de France peut être sujette à une autorisation administrative. L’obtention du document concerné ne relève que de la responsabilité de l’adjudication du lot concerné par cette disposition. Le retard ou le refus de délivrance par l’administration des documents de sortie du territoire, ne justifiera ni l’annulation de la vente, ni un retard de règlement, ni une résolution. 11– CITES Chaque lot en ivoire vendu aux enchères fera l’objet d’une déclaration CITES, reprenant les contacts du vendeur, mais aussi de l’acheteur. Les objets décrits dans le présent catalogue contenant de l’ivoire d’Elephantidae supp (I/A), pré-convention, antérieur au 3 mars 1947 et ayant subi une destruction mécanique par débit de placage, découpe ou tournage et de ce fait conforme au Règle XE 338/97 du 09/12/1996 art.2-Wmc, peuvent être commercialisés après obtention d’un CIC préalable à toute vente, conformément à la directive européenne CE 2021/2280 du 16/12/2021 et son application à partir du 19 janvier 2022. L’adjudicataire s’engage à fournir sans délai à Boisgirard-Antonini toutes les informations éventuellement nécessaires à toutes fines douanières pour ce faire. L’adjudicataire est seul tenu d’accomplir toutes autres diligences résultant de la nature particulière d’un tel lot sous sa responsabilité. En particulier, il lui appartient de faire les démarches imposées par ses éventuelles revente ou exportation hors de France, notamment la demande d’un nouveau XIX de ré-export sera nécessaire, celui-ci étant à sa charge. La délivrance d’un tel document n’étant pas automatique. Pour une éventuelle réexportation hors de France, il appartiendra à l’adjudicataire de se renseigner – préalablement à tout achat- auprès des douanes du pays destinataire. Conformément à la nouvelle législation européenne du 16 décembre 2021, ce lot ne pourra pas sortir de l’Union Européenne. 12– TEMIS Boisgirard-Antonini à recours à la plateforme TEMIS opérée par la société Commissaires-Priseurs Multimédia, aux fins de gestion du recouvrement des Bordereaux impayés. Dans ce cadre, en cas de retard de paiement, les données à caractère personnel relatives aux enchérisseurs, ou leurs représentants, (notamment identité et coordonnées des enchérisseurs, informations relatives à la vente, bordereaux) sont susceptibles d’être communiquées à CPM aux fins de gestion du recouvrement amiable de créance. CPM intervient en qualité de sous-traitant au sens du Règlement général sur la protection des données (Règlement UE 2016/679 du 27 avril 2016). INCIDENTS DE PAIEMENT – FICHIER DES RESTRICTIONS D’ACCÈS DES VENTES AUX ENCHERES (TEMIS) Tout bordereau d’adjudication demeuré impayé après de Boisgirard-Antonini ou ayant fait l’objet d’un retard de paiement est susceptible d’inscription au Fichier des restrictions d’accès aux ventes aux enchères (« Fichier TEMIS ») mis en oeuvre par la société Commissaires-Priseurs Multimédia (CPM), société anonyme à directoire, ayant son siège social sis à (75009) Paris, 37 rue de Châteaudun, immatriculée au registre du commerce et des sociétés de Paris sous le numéro 437 868 425. Le Fichier TEMIS peut être consulté par tous les structures de vente aux enchères opérant en France abonnées à ce service. La liste des abonnés au Service TEMIS est consultable sur le site www.interencheres.com, menu « Acheter aux enchères », rubrique « Les commissaires-priseurs ». L’inscription au Fichier TEMIS pourra avoir pour conséquence de limiter la capacité d’enchérir de l’enchérisseur auprès des Professionnels Abonnés au service TEMIS. Elle entraîne par ailleurs la suspension temporaire de l’accès au service « Live » de la plateforme www.interencheres.com gérée par CPM, conformément aux conditions générales d’utilisation de cette plateforme. Dans le cas où un enchérisseur est inscrit au Fichier TEMIS, Boisgirard-Antonini pourra conditionner l’accès aux ventes aux enchères qu’elle organise à l’utilisation de moyens de paiement ou garanties spécifiques ou refuser temporairement la participation de l’Enchérisseur aux ventes aux enchères pour lesquelles ces garanties ne peuvent être mises en œuvre. The payment of the lot will be made cash, for the whole of the price, costs and taxes, even when an export licence is required. If the seller does not make this request within a month from the date of the sale, the sale will be automatically cancelled, without prejudice to any damages owed by the defaulting buyer.
